| The Ombudsman considers that he can decide at his absolute discretion what is meant by the word 'injustice' as used in the Local Government Act 1974, and can simply choose to discontinue an investigation, (in 2003/4, he reported 2,814 cases (21.7%) as 'Ombudsman's discretion not to pursue complaint'). He only agrees to investigate a complaint if he considers, at his absolute discretion, that there has been 'significant' or 'material' injustice caused to the complainant, even though the Local Government Act 1974 simply refers to 'injustice'. |
